1. Introduction

Welcome to Literra ("we," "our," or "us"). Literra is an academic writing assistant platform that helps users compose academic writings from documents they provide. By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Definitions

  • "Service" refers to the Literra application, website, and all content, services, and products available through our platform.
  • "User" or "you" refers to any individual or entity that accesses or uses our Service.
  • "Content" refers to any documents, text, data, information, or other materials uploaded, downloaded, or appearing on the Service.
  • "User Content" refers to content uploaded or provided by users for processing by our Service, including but not limited to documents, academic papers, research materials, notes, and any text or data that you input into the Service for analysis or processing.

3. User Accounts

To use certain features of our Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

We use third-party authentication providers (Google, Microsoft, and Discord) to facilitate user registration and login. These providers share only basic information with us, including your email address, name, and profile image. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Payment and Subscriptions

Literra offers subscription plans for access to premium features. All payments are processed through Stripe, our third-party payment processor. By providing payment information, you agree to the following terms:

  • You authorize us to charge your payment method for the subscription fees at the then-current rates.
  • Subscriptions automatically renew unless canceled by you before the renewal date.
  • We reserve the right to change subscription fees upon notice. Such notice may be provided through the Service, via email, or by posting on our website.
  • Refunds are handled in accordance with our Refund Policy detailed below.

4.1 Refund Policy

As Literra is based in the Czech Republic, our refund policy complies with Czech consumer protection laws and EU regulations:

  • You have the right to withdraw from the purchase without giving any reason within 14 days of the subscription purchase date, provided you have not used any credits or premium features.
  • Once you have used any portion of the service (including using credits or accessing premium features), you acknowledge that you have begun using the digital content and your right to withdrawal may be limited.
  • To request a refund, contact us at support@literra.com with your account details and purchase information.
  • Approved refunds will be processed through your original payment method within 14 days of your refund request approval.

5. Acceptable Use

You agree to use our Service for legitimate academic and research purposes only. You are responsible for all User Content that you submit to our Service. You agree not to:

  • Use the Service to violate any applicable law or regulation.
  • Submit User Content that infringes on the intellectual property rights of others.
  • Use the Service for the purpose of plagiarism or academic dishonesty.
  • Use the Service to create, distribute, or promote harmful, fraudulent, or misleading content.
  • Attempt to interfere with, compromise the security of, or disrupt the Service.
  • Use any automated system, including "robots," "spiders," or "offline readers" to access the Service in a manner that sends more request messages than a human could reasonably produce.

6. User Content and Intellectual Property Rights

You retain all ownership rights to your User Content. By uploading or submitting User Content to our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process this content for the purpose of providing and improving our Service.

All content on the Service, including but not limited to text, graphics, logos, and software, is the property of Literra or its content suppliers and is protected by copyright and other intellectual property laws.

7. Third-Party Services

Our Service integrates with third-party services to provide essential functionality. These services include:

  • Neon - Database hosting (has access to user uploaded data)
  • Upstash - Data storage (has access to user uploaded data)
  • PostHog - Analytics (has access to user uploaded data)
  • Langfuse - Performance monitoring (has access to user uploaded data)
  • Google - Authentication and LLM APIs (has access to user uploaded data)
  • Microsoft - Authentication
  • Discord - Authentication
  • Stripe - Payment processing
  • Vercel - Hosting and deployment (may have access to user data in logs)
  • Datadog - Application monitoring (may have access to user data in logs)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, privacy policies, or practices of any third-party services.

By using our Service, you acknowledge and agree that your User Content may be processed by and shared with these third-party services as necessary to provide the Service's functionality.

8. Limitation of Liability

Literra provides an AI-powered writing assistant that uses large language models (LLMs) to generate content based on user inputs. Despite our best efforts to provide accurate and reliable results, LLMs may occasionally produce incorrect, incomplete, or misleading information ("hallucinations").

YOU EXPRESSLY UNDERSTAND AND AGREE THAT LITERRA SHALL NOT BE LIABLE FOR:

  • Any inaccuracies, errors, or hallucinations in the content generated by our Service.
  • Any academic, professional, or personal consequences resulting from the use of our Service or reliance on content generated by our Service.
  • Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or academic standing.
  • Any damage to your computer system or loss of data resulting from the use of our Service.

YOU AGREE THAT YOU USE THE SERVICE AT YOUR OWN RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. For consumers who are EU residents, this does not deprive you of the consumer protection rights granted by the mandatory laws of your country of residence. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
